1. Use of Montana.Net constitutes acceptance of this Usage Agreement.
All Montana.Net customers are responsible for reviewing and complying
with this document. This document is subject to change with notice
by publication on the Web at http://www.montana.net/.
Customers are responsible for monitoring this Web site for changes.

2. Montana.Net may only be used for lawful purposes. Customers agree
to indemnify and hold Montana.Net harmless from any claims or damages
by themselves or another party which result directly or indirectly from
unlawful use. Montana.Net customers may not use Montana.Net's network,
machines or services in any manner which violates any U.S. or state
law or regulation, or violates the acceptable use policies of any networks,
machines or services accessed through Montana.Net.
3. Prohibited activity includes but is not limited to unauthorized
use (or attempted unauthorized use) of any machines or networks, denial
of service attacks, falsifying header information or user identification
information, monitoring or scanning the networks of others without permission,
sending unsolicited bulk e-mail or advertising, collecting e-mail addresses
from the Internet for the purpose of sending unsolicited bulk e-mail
or to provide collected addresses to others for that purpose, transmitting
or receiving copyright-infringing, threatening or obscene material,
material protected by trade secret; as well as transmissions of any
type or quantity that cause disruption of services to others, or propagation
of computer viruses or worms.
4. Unless a customer has a constant-connect account, the account is
to be used only in an interactive manner. Interactive use means the
customer is actually sitting in front of his/her computer actively using
our service. Dialup connection customers may not run programs or configure
machines in such a way as to keep a dialup connection active when not
in use or to otherwise bypass automatic disconnection for inactivity,
unless they have a constant-connect account. Customers who are found
to be utilizing such means to gain non-interactive internet access will
be offered the choice of either utilizing their dialup access in the
intended manner or upgrading to a constant-connect type of access account,
with the alternative to these two choices being termination of their
account. Montana.Net's dialup access servers will disconnect after 10
minutes of inactivity and after 3 hours of continuous access.
5. Montana.Net strives to provide the best possible service, but makes
no warranties of any kind, whether expressed or implied, for the service
it provides. This includes loss of data resulting from delays, nondeliveries,
misdeliveries, or service interruptions caused by its own negligence,
failures within the telephone or internet infrastructure, or user errors
or omissions.
6. Montana.Net does not normally examine messages or files residing
on or passing through its computer system, and exercises no control
whatsoever over the content of the information residing on or passing
through it. Montana.Net specifically denies any responsibility for the
accuracy or quality of information obtained through its services. Use
of any information obtained via Montana.Net is at the user's own risk.
7. Montana.Net may occasionally require new registration and subscription
information from a customer to continue their service. Should this become
necessary, the customer will be notified. If changes to a customer's
subscription information occur on the customer's end, including changes
in credit card information in the case of customers utilizing credit
card billing, the customer agrees to notify Montana.Net so that its
information is current and accurate.
8. Customers have the right to terminate their subscription at any
time, for any reason. Montana.Net also has the right to terminate a
customer's subscription at its discretion, for reasons including, but
not limited to, violating this Usage Agreement, untimely payment or
non-payment of charges for service fees and surcharges, repeated incidents
of complaints from other network users which Montana.Net determines
to be valid, or inappropriate usage determined by Montana.Net or other
relevant authorities. If a customer's subscription is terminated, the
customer will be refunded the unused portion of their service fees,
less any unpaid balances owed to Montana.Net. The only refund exception
applies during a customer's initial quarter of service, which is nonrefundable
in lieu of an account activation fee.
9. This Usage Agreement reflects the entire agreement between you,
the subscriber, and Montana.Net, and supersedes all prior oral
or written agreements and understandings between the subscriber
and Montana.Net. This Usage Agreement shall be governed and interpreted
in accordance with the laws of the State of Montana, United States
of America.
